The objects and reasons of this Bill are to amend various laws relating to personal autonomy, mainly the Code of Organization and Civil Procedure, Civil Code, Marriage Act, Equal Opportunities (Persons with Disability) Act and Mental Health Act, to give better effect in Maltese law to the provisions of Article 12 of the United Nations Convention on the Rights of Persons with Disabilities, in particular to introduce a supported decision-making regime in place of a guardianship regime, abolish interdiction and incapacitation, align the Marriage Act with relevant legislation, equalise treatment of persons within the remit of the Mental Health Act, and assign oversight of relevant measures to the Commission for the Rights of Persons with Disability.
