Reference is being made to SL 465.69 of the Laws of Malta that came into force on 17th January 2022 as per Legal Notice 8 of 2022. Regulation 2 (1) of SL. 465.69 establishes that in order for a person to access any, bar, club or każin; Restaurant; Snack bar; Cinema; Theatre, Casino or bingo hall or gaming parlour, Sport event, Gym or fitness centre, Public swimming pool, spa or sauna, organised mass event, Exhibition, must be in possession of a valid certificate of a recognised vaccination in accordance to the appreciable criteria as defined in the standards issued by the Superintendent of Public Health. These legislative measures fall short in striking a fair balance between the public health concerns of society at large and the freedoms of individuals (freedom of choice and respect of private life). Effectively, people living in Malta are only allowed to continue enjoying their private life provided they are administered the vaccine. The national authorities have failed to include other effective alternatives. These Regulations and Standards issued under the Public Health Act go beyond what is necessary and effective in a democratic society.
 
Wherefore I/we respectfully request the House of Representatives to
amend SL 465.69 of the Laws of Malta together with the relevant Standards issued under the Public Health Act.
 
Closing remarks
The House of Representatives has a duty to ensure that regulations and measures are necessary and proportionate when seeking to achieve a particular outcome.
