Objects and Reasons

The objects and reasons of this Bill are to re-establish the Environment and Planning Review Tribunal as a truly independent and impartial adjudicator, providing for security of tenure, clearly defined criteria for the appointment and removal of members, and guarantees of institutional autonomy in accordance with constitutional and European standards of Administrative Justice, by introducing and establishing new procedures, suspending permits when an appeal is filed by an interested third party or an external consultant in relation to a planning application, binding standards for decision-making, finalising factual determinations and introducing mandatory deadlines in order to give efficiency to the process. Furthermore, this Bill provides for the simplification of processes, filing of documents by electronic means control against abuses, and wide corrective powers to ensure effective and modern justice.
