Objects and Reasons

The objects and reasons of this Bill are to maintain the legality and effectiveness of the freezing of the property of persons charged or accused with offences which are relevant offences for the purposes of the Proceeds of Crime Act (Cap. 621) during the time when criminal proceedings are pending. This is being proposed in the context of protecting society from economic crime. Accordingly, the Bill makes provision for Courts to be enabled to ensure the proportionality of such orders in line with the criteria established in the case law of the European Court of Human Rights. The Bill also proposes amendments in respect of attachment orders issued at the investigation stage, makes further provision in respect of nonconviction-based confiscation to provide, inter alia, for European
Union sanctions to also be covered specifically and provides for further powers of the Asset Recovery Bureau. The Bill also provides for the uniformity, when possible, of procedures for the attachment, freezing and confiscation of the proceeds of crime as applicable under various laws.
